Contractual Relationship
These terms and conditions represent a formal agreement between the BOATCOM (BOATCOM’ Application), the Vender/retailer which is also the delivery service provider for this application, and these service provider terms govern your use of the BOATCOM (BOATCOM’ Application), which is an electronic platform that allows agents to provide delivery services to customers’ homes or to locations that are specified advance from clients or its customers. Arranging and scheduling transportation or logistical services are responsibilities with the Vender/retailer themselves providing such services.
Any use by you of the services provided by the BOATCOM (BOATCOM’ Application) constitutes your acceptance and acknowledgment of this agreement and its provisions. Accordingly, you must not use the application if you do not agree to these terms and conditions contained in this agreement.
BOATCOM (BOATCOM’ Application) reserves the right to amend or change any of these terms and conditions without prior notice, as well as to perform any cancellation, freezing or confiscation of the driver’s or vender’s or retailer’s wallet balance without the slightest objection or reluctance when it is proven that there is any fraud from the delegate, and it is your responsibility as a user of the application to review the controls, terms of use periodically for updates on the terms and conditions.
Your access to and use of the services is considered your agreement to be bound by these terms and conditions, which creates a contractual relationship between you and BOATCOM (BOATCOM’ Application), and in the event that you do not agree to these terms, you may not obtain or use the services. These Terms specifically supersede any prior agreements or arrangements with you.
BOATCOM (BOATCOM’ Application) may terminate these Terms or any of the Services relating to you immediately. Or in general, stop offering the Services or prevent access to them or any part of them at any time and for any reason.
Some supplemental terms may apply to certain services, such as the policies for a particular event, activity or promotion or discounts, and these supplemental terms will be disclosed to you in relation to the services provided, the supplemental terms are added to the terms for the purposes of the services provided and are considered part of them. Supplemental Terms shall prevail over these Terms and in the event of a conflict with respect to the Services provided.
The BOATCOM (BOATCOM’ Application) may amend the conditions related to the services from time to time. Modifications shall be effective upon the publication of these updated Terms on the Application or the publication of the revised policies or supplemental terms relating to the Service provided. Your continued access to or use of the Services after such posting constitutes your agreement to be bound by the Terms as amended.
We collect and use personal data in connection with the Services in accordance with the BOATCOM (BOATCOM’ Application) Privacy Policy. The Company may provide the necessary information (including your contact information) to claims settlement companies or insurance companies in the event of a complaint, dispute or disagreement that may include an accident between you and an external service provider (including a representative of a company in the transportation network) where such information or data is necessary to settle the complaint, dispute or disputes.
Services
The services constitute a technical platform that enables End Users & Vender/retailer of mobile applications or websites of the BOATCOM (BOATCOM’ Application), which are available as part of the arrangement and scheduling, assignment of delivery and / or logistics services by the Vender/retailer. BOATCOM (BOATCOM’ Application) provides a platform where these Vender/retailer may connect, schedule, deliver to its customers and is not responsible for the delivery of these products, items or services provided by the Vender/retailer.
Application
Each of the Services shall be referred to as the Independent Providers for these Services, including independent third party delivery service providers used by the Vender/retailer and third party logistics service providers used by the Vender/retailer by providing the Services (“Logistic Service Providers”) under the agreement with BOATCOM (BOATCOM’ Application) Application for your personal, non-commercial use only unless you agree otherwise It is in a separate written agreement with you. You acknowledge that BOATCOM (BOATCOM’ Application) does not provide delivery services or logistics services or operate as a delivery company and that all delivery or logistics services are provided by either Vender/retailer themselves or independent external companies that do not work for BOATCOM (BOATCOM’ Application).
License
Provided that you comply with these terms, BOATCOM (BOATCOM’ Application) grants you a limited, non-exclusive license that cannot be sub-licensed, transferable to another person and is revocable to: Access and use the Applications on your personal device in connection with your use of the Services only. - access and use any of the content, information and related materials that may be made available through the Services. In all such cases, the use is for personal and non-commercial use only. BOATCOM (BOATCOM’ Application) reserves any of the rights granted to it in these terms.

The provision of services
You acknowledge that portions of the Services may be made available under the various BOATCOM (BOATCOM’ Application) trademarks or ordering options related to delivery or logistics services, including the types of transportation services referred to at the present time.
BOATCOM (BOATCOM’ Application) Independent third-party service providers, including delivery network company drivers, delivery charter permit holders, permit holders or others with or similar delivery licenses.
Third party services and content
The Services may be provided or accessed in conjunction with third-party services and content (including advertising) that are not under the control of BOATCOM (BOATCOM’ Application). You acknowledge that different terms of use and privacy policies may apply to your use of third party services and content. BOATCOM (BOATCOM’ Application) does not endorse the third-party services and content and is not in any way responsible for any of the products or services of the third-party service providers. In addition, Google, Microsoft Corporation, BlackBerry Limited or their respective international subsidiaries and affiliates are external beneficiaries of this Contract if you access the Services using the Application designed specifically for Android, Microsoft or BlackBerry mobile devices. These third party beneficiaries are not parties to this contract and are not responsible for providing or supporting the Services in any way and your access to the Services using such devices is subject to the terms set forth in the applicable External Beneficiary Terms of Service.
Property
The Services and all rights related to them remain the property of BOATCOM (BOATCOM’ Application) or its licensors. Neither these Terms nor your use of the Services grant you any rights:
In or in connection with the Services other than the limited license granted above.
To use or refer in any way to company names, logos, product and service names, trademarks or service marks of BOATCOM (BOATCOM’ Application).
Your use of the Services
User Accounts In order to use most aspects of the Services, you must register for and maintain an active personal account for the Services and you must be at least 18 years of age or of legal majority in the User ("Account"). Account registration requires that you provide certain personal information to BOATCOM (BOATCOM’ Application) such as your name, address, mobile phone number and age, in addition to at least a valid bank account number. You agree to record and maintain accurate, complete and up-to-date information in your account. Your failure to maintain accurate, complete and current information in your account, including the designation of a bank account for you, your inability to access or use of the Services or the termination of these Terms with you may result in your failure to maintain accurate, complete and current information on your account. You are responsible for all activities that occur under your account or sub-accounts created there within and agree to maintain the security and confidentiality of your account or sub-accounts there within; username and password at all times. You are not entitled to have more than one account unless BOATCOM (BOATCOM’ Application) allows you in writing otherwise.
User requirements and behavior
The Service is not available for use by persons under 18 years of age. You may not authorize the use of your account to third parties, nor may you allow persons under 18 years of age to obtain delivery and logistics services from external service providers unless they are accompanied by you. You may not assign or transfer your account to any other person or entity. For example, you agree. Comply with all applicable laws when using the Services and you may use them only for lawful purposes and not transfer illegal or dangerous materials. You may not, in your use of the Services, cause harm, annoyance, inconvenience, or property damage to either the Service Providers or their use of the Services, and you agree that you may be denied access to or use of the Services if you refuse to provide proof of identity.
*Text messages
Once the account is created, you agree that the Services may send you some informational text messages as part of the normal business course of your use of the Services. You have the right to refuse to receive text messages from BOATCOM (BOATCOM’ Application) at any time by contacting technical support and stating that you do not want to receive a combination of messages, including the mobile number that receives these messages. You acknowledge that refusing to receive text messages may affect your use of the Services.
User-Generated Content
BOATCOM (BOATCOM’ Application) may, in its sole discretion, allow you from time to time to submit, upload, post or otherwise provide text, audio or visual content and information to BOATCOM (BOATCOM’ Application) through the Services, including comments and feedback relating to any Generated Content. ("User Content") on the Services, creating support requests, and submitting entries for competitions and promotions by User Submissions remain your property. However, once you submit User Generated Content to BOATCOM (BOATCOM’ Application), you grant it a worldwide, perpetual, irrevocable, royalty-free license, as well as the right to sublicense, use, copy, modify, create, distribute, and publicly display the User Content. publicly perform it and exploit it in any other way in all forms and distribution forces now known or hereafter developed (including in connection with the services and business of BOATCOM (BOATCOM’ Application), Application as well as the sites of third-party services. Without additional notice to you or obtaining your consent and without having to pay you or any other person or entity.
You undertake and warrant that:
You are either the sole and exclusive owner of all User Content or you have all rights and all licenses, consents, and releases necessary to grant a license to BOATCOM (BOATCOM’ Application) to use the User Content as set forth above.
Neither the User Content nor your submission, uploading, posting, or otherwise making available of such User Content nor use of the User Content shall infringe, misappropriate or infringe any of the intellectual property rights, proprietary rights, copyrights or privacy rights of a third party or result in a breach of any applicable laws or regulations.
You agree not to submit any User Content that is defamatory, hateful, violent, obscene, pornographic, illegal or offensivein any other way. This is in the manner determined by BOATCOM (BOATCOM’ Application) at its absolute discretion, whether or not this article is protected by law BOATCOM (BOATCOM’ Application) may review, monitor or remove User Content at its sole discretion at any time and for any reason without notice to you, but is not obligated to do so.
Access to network and devices
You are responsible for obtaining the network access data necessary to use the Services. Data and messaging rates and charges applied by the mobile network to which you subscribe may apply to you if you access or use the Services from a wireless device, and you are responsible for these rates and charges. You are responsible for acquiring and updating appropriate equipment or devices that are necessary to access and use the Services and Applications and any updates thereto. BOATCOM (BOATCOM’ Application) does not warrant that the Services, or any part thereof, will operate on any equipment or devices. In addition, the Services may suffer from malfunctions and delays inherent in the use of the Internet and electronic communications.
Payment of
You understand that use of the Services may result in you being charged for the services or goods obtained from BOATCOM & its BOATCOM’ Application and after you receive the services or goods obtained through your use of the Service, your ("Fees") to pay the applicable amounts on behalf of the third party services as the third party service provider's limited payment collection agent. Payment of the fee in this way will be considered as if the payment were made directly by you to the Third Party Provider and the charges as required by the third party. All fees are from a third party service provider for the services and goods you have received from the time you receive those services and goods. Accordingly, BOATCOM (BOATCOM’ Application) will respond to any request from any external service provider to amend the fees for a particular service or good. The BOATCOM’ Application platform (“Fees”) will not be more then 1% (+) plus VAT of any order amount through BOATCOM & its BOATCOM’ Application. The fees will include applicable taxes as provided by law. An additional Margin Sharing (“Fees”), not exceeding 2% of any given order amount will be charged; this fee is a sharing charge will be reduced as daily sales volume increases through BOATCOM & its BOATCOM’ Application according to BOATCOM & its BOATCOM’ Application location specific sales policy. There may be additional intra-application charges which BOATCOM & its BOATCOM’ Application may charge on exceptional basis such as but not limited to: promotional, “pass by service” or T’morly service charge, storage capacity per vender/retailer, discounts which will be disclosed on a per item or per date basis depending on specific locations or per vender/retaiker choice.
All fees are due with immediate effect, and the payment process is facilitated by BOATCOM (BOATCOM’ Application) using your preferred payment method specified in your account, after which BOATCOM (BOATCOM’ Application) will successfully send you the payment process through the application. If the Primary Payment Method you have designated in your Account is expired, invalid, or cannot be paid, you agree that, as the Third Party Provider's Limited Payment Collection Agent, may use the Secondary Payment Method in your Account, if any and as is Agreed upon between you and the Company, the Company reserves the right to create, cancel and/or revise the fees for any or all services or goods obtained through the use of the Services at any time in the sole discretion of BOATCOM (BOATCOM’ Application). Further, you acknowledge and accept that fees applicable in some geographic areas may increase significantly during times of high demand. BOATCOM (BOATCOM’ Application) will use reasonable efforts to notify you of fees that may apply to you if you are responsible for fees incurred in your account regardless of your knowledge of them or the amounts in that account. The Company may from time to time provide some users with promotional offers and discounts that may result in varying amounts being paid for obtaining the same services or goods or for obtaining similar services and goods while using the Services and you agree that such promotional offers and discounts shall not - unless You may also - relate to your use of the Services or fees charged to you. You may choose to cancel your order for goods or services from a Third Party Provider at any time prior to the arrival of the Third Party Provider since in the event that the Third Party Provider arrives, you may be required to pay a cancellation fee.
This payment structure is intended to fully compensate the external service provider for the services and goods provided. Except in connection with taxi transportation services ordered through the Application, we do not assign any portion of your payment as a tip or tip to the third party service provider. Any statement made by BOATCOM (BOATCOM’ Application), (on its website, app or marketing materials to BOATCOM (BOATCOM’) & Application) that gratuities are 'voluntary', 'unconditional' and/or 'included' in payments you make for services or goods provided is not intended to indicate The Company provides any additional amounts to the external service provider other than the amounts indicated above. You understand and agree that while you are free to tip additional payments to any third party service provider who provides services and goods to you through the Service, you are not obligated to do so. Tips are paid voluntarily. After you have obtained services and goods through the Service, you will have the opportunity to rate your experience and provide additional feedback regarding the Third Party Provider.
Evacuation responsibility
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". BOATCOM (BOATCOM’) company & Application disclaims all express, implied, or statutory representations and warranties not expressly set forth in these Terms, including the implied representations of merchantability, fitness for a particular purpose and non-infringement. In addition, BOATCOM (BOATCOM’ Application) makes no representations, representations or warranties regarding BOATCOM (BOATCOM’ Application).
The value, timeliness, quality, suitability or availability of the Services or any of them or the Goods requested while using these Services or regarding the uninterruption or error-freeness of the Services. We do not guarantee the quality, suitability, safety or ability of the Third Party Providers. YOU AGREE THAT THE ENTIRE RISK ARISING OUT OF YOUR USE OF THE SERVICES OR ANY OF THE SERVICES OR GOODS REQUIRED IN CONNECTION WITH SUCH USE RESERVES SOLELY TO YOU TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW
Limitation of Liability
It will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of profits, loss of data, personal injury or property damage related to or in any way caused by the use of the Services even if it has been advised of the possibility of such damages. and will not be liable for any damages, liabilities or losses.
Arise from:
Your use of or reliance on the Services or your inability to access or use the Services.
any business transaction or relationship between you and any third party service provider, even if we have been advised of the possibility of such damages. BOATCOM (BOATCOM’ Application) shall not be liable for delay or breach of performance arising from causes beyond BOATCOM (BOATCOM’ Application) reasonable control. You acknowledge that third party transportation service providers that provide such services requested through certain types of orders may provide delivery sharing or peer-to-peer transportation services, and that they may not be professionally licensed or authorized.
For ordering and scheduling delivery services or the provision of goods or logistics by third party service providers You may use third-party services but you agree that we have no responsibility or liability to you for any of the delivery services or the provision of goods or logistics to you by such third-party service providers except as It is expressly stated in these Terms.
THE LIMITATION OF LIABILITY AND DISCLAIMER CONTAINED IN THE LIMITATION OF LIABILITY DO NOT CONSENT OR ALTER YOUR RIGHTS AS A CUSTOMER THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
Confidentiality of the information
You undertake not to disclose any written or oral information obtained by you from the Company or the beneficiary of the service. Your breach or violation of any of these Terms.

Refund and Return Policy:
boatcom takes customer satisfaction very seriously. In the case of problems with your order, please send us an email on info@boatcom.com.sa and we will assist you. In appropriate cases, if you have already been billed by boatcom, boatcom will issue full or partial refunds.
If you are unsatisfied with any of our products, please contact boatcom Team and we will be happy to offer a replacement item if the time allows. In certain cases, a discount may be offered against your next purchase, which will be credited to you.
